Call to order and minutes

Chair Marnie MacAlpine [0:14:19] Good evening, everyone. This is a meeting of the Chelsea Licensing Commission. Today is Thursday, October 8, 2026. I am joined by my fellow commissioners, Enio Lopez, Mike McAteer, Emily Cherniack, Alexandria Christmas is on her way, so she should be here in a moment. Myself, Marnie MacAlpine, we have Bea Hernandez from our licensing department, as well as Mark Rossi, our Assistant City Solicitor. In addition, we have Captain [name unclear] from the Chelsea Police Department, Officer [name unclear] from the police department as well. So with that, we will get things started to kick off our meeting. We’re looking to get an approval of our minutes from the August 13 and August 10 meetings.

Clerk's update and communications

Licensing Administrator Beatrice Hernandez [0:15:39] Okay, so for the clerk’s update, we have a reminder that it is renewal season for the following licenses. Liquor, Amusement and Entertainment, Common Victualler, Class one, two, and three, lodging house. And Constable, as you guys should know, all licenses expire on 31 December. And to ensure that the licenses are approved and issued in a timely manner, all applications are required with supporting documents to be completed and passed in by November 27th. That’s. That’s it for the clerk’s update. And as far as the communications, so we have two parts of the communications, we have a. For the Merritt Club, the application for change of manager was withdrawn. So what they want to do with this is to keep Robert as a manager. And this was approved by the ABCC. So we have email conversations as proof stating that this is fine, nothing further needs to be done with it, and they can just continue.

Licensing Administrator Beatrice Hernandez [0:17:02] Second communications was late communications. We received notices for appeal hearings for King Tacos and Ranchos Las Pupusas [names as heard]. So their appeal hearings are for the decisions that were made on their disciplines. This will take place with the ABCC, and that’s set for Monday, November 2nd of 2026. That’s.

Chair Marnie MacAlpine [0:17:31] Thank you. Appreciate that. Before we get into the public hearings, just a couple of housekeeping notes for anybody that needs interpretation. We do ask that you each take your turn stepping up to that microphone to speak as it makes it clearer for us to hear you as well as for folks who may be watching from home or watching a recording of our meeting at a later date. So with that, we’ll go right into our public hearings. I did actually hear from our police department, so I was going to ask the commission if we could go out of order.

Disciplinary hearing continued: Fannies Place Inc., d/b/a Chelsea Walk, 416 Broadway

Commissioner [0:19:01] Sure.

Chair Marnie MacAlpine [0:19:02] The third item on our agenda is a disciplinary public hearing. And in speaking with our police department, we would be looking to do a continuance to our next meeting for this disciplinary matter as they don’t have the video for us today. That that is due to an internal person at the police department that’s not related to the establishment. So the police department has requested. If I am correct, Captain [name unclear], that is correct.

Police captain [0:19:38] Plus also the officer that investigated this is not able to be here today as well. That’s the other part of the issue also.

Chair Marnie MacAlpine [0:19:48] So if it is okay with the commission, I’d like to see if anybody would like to agree to move this to our next meeting so Officer McLaughlin can be here to speak to her investigation and we can have the video surveillance that the police department collected before we make a decision.

Petroleum storage license: Chelsea SPI, LLC, 571 Washington Avenue

Chair Marnie MacAlpine [0:20:19] Moving back into order, the first hearing on our agenda is a continued public hearing to consider a new petroleum storage license application for Chelsea SPI, LLC at 571 Washington Ave, Chelsea, Mass.

Representative, Chelsea SPI, LLC [0:20:49] Hi, I am [name unclear]. I’m here representing Super Petroleum for our Chelsea Petroleum Storage license.

Chair Marnie MacAlpine [0:20:59] It’s nice to see you again.

Representative, Chelsea SPI, LLC [0:21:00] Nice to see you as well.

Chair Marnie MacAlpine [0:21:02] How are we doing on everything since you were here last month?

Representative, Chelsea SPI, LLC [0:21:06] I’ve took care naturally of everything should be all set.

Chair Marnie MacAlpine [0:21:12] So I see in our packet that there is a temporary occupancy permit, correct? That is set to expire next week. How are we doing on a full permit?

Commissioner Mike McAteer, director of inspectional services [0:21:23] So the [unclear] hadn’t been inspected in 50 years. He did everything but there’s a little bit more electrical work. He’s on pace.

Representative, Chelsea SPI, LLC [0:21:30] We did the electrical work. It’s all taken care of. The permit is also. We pulled the permit ready. We’re just waiting for it to go through. Tommy gave us word that he’s going to put it through. So we’re just waiting on Tommy now.

Chair Marnie MacAlpine [0:21:42] So is ISD planning on issuing another temporary permit if that work has not been completed before? The turn.

Commissioner Mike McAteer, director of inspectional services [0:21:50] No, Tommy will inspect. He hasn’t inspected. I’ll know more when he inspects it. I don’t know if your electrical electricity called. Once he calls him if it passes and says occupancy for him, I don’t think it’s a ton of work.

Chair Marnie MacAlpine [0:22:04] That’s not.

Chair Marnie MacAlpine [0:22:06] My concern. The concern is we need to make sure that we’re following rules. So my concern. Like, right now, you have an occupancy permit. That’s fantastic. You’re doing the things to get everything done. My concern is if that occupancy permit expires on. I believe it’s the 16th and you don’t have everything done and the approval for your actual occupancy permit, you’d have to shut your doors. At that time.

Representative, Chelsea SPI, LLC [0:22:33] My electrician and Tommy worked closely, and he was very on it, and he told them all the work that was done. He said, you guys are all set. I’m gonna sign off. That was his work. So I’m very confident it’ll be. As long as someone signs off on it, I’m sure it’ll be good before the date.

Chair Marnie MacAlpine [0:22:49] Okay.

Commissioner Mike McAteer, director of inspectional services [0:22:50] I just don’t want to do the inspection. Tommy do the inspection? Did he already do the inspection?

Representative, Chelsea SPI, LLC [0:22:55] No, weirdly enough, I don’t think so. But he liked my electrician that they met in person, and it seemed like you trusted him. But I can’t force someone to come to my station and do the inspection.

Chair Marnie MacAlpine [0:23:17] I just don’t want you to end up in a situation absolutely. Where you get shut down because you don’t have the required.

Commissioner [0:23:33] So if. If I recall, you’re operating on the old [unclear].

Representative, Chelsea SPI, LLC [0:23:39] Actually, I wish we could have done that. They closed us down the Tuesday after the meeting.

Commissioner [0:23:45] Oh, okay.

Representative, Chelsea SPI, LLC [0:23:46] And then. And they said that we couldn’t. So then I was. I acted very frantically right after the meeting happened, and I got everything done or tried to had the electrician pull the permit and then didn’t have anyone sign off on it. So then I came here a couple times. I spent the whole week here talking to everyone, trying to get someone to sign it, and they said that the person who did the original inspection isn’t available this week. And then it has to be that person who comes and sees it. So it was like, oh, great. I could close the whole week. And then I spoke to. I think his name was Hector maybe.

Commissioner [0:24:19] Yeah, it’s Hector.

Representative, Chelsea SPI, LLC [0:24:20] Hector. Really nice guy. But I met him that Friday, so I was closed the whole week. Met him Friday. He let Tommy come and check it out. And then Tommy gave us a whole new list of things that wasn’t brought to our attention the first inspection. So I said, it is what it is. And I. And then he gave. He said that it’s very. It’s still safe. And we kind of got screwed over in a sense, because we have all these things that we didn’t put in any of it, and we don’t even use any of that space, but we have to take care of it. So showed my inspector everything. He said it’s still safe, though. So he gave us a temporary and then reacted immediately to fix all those things. In the meantime, though, I also got. I made sure to get signed off and that every other department hadn’t signed off yet.

Commissioner [0:25:03] So I guess my question is, if he’s just waiting for the inspection services, like, what is our action steps? Because it looks like he’s getting closer.

Chair Marnie MacAlpine [0:25:12] So I will ask Mark if I’m correct in what I’m about to say, that we would be able to approve a license pending the occupancy permits being finalized and all appropriate permits and fees being in place with the city, because

Commissioner [0:25:33] he’s much closer than he was on last month. So I also feel confident that you will get it done before. There’s no point of holding, having you come back another month.

Representative, Chelsea SPI, LLC [0:25:43] Yeah. Thank you.

Commissioner [0:25:44] Way much closer than it was last time.

Representative, Chelsea SPI, LLC [0:25:47] Yeah, it is.

Chair Marnie MacAlpine [0:25:51] So to be clear, like. So when, like, we approve that, but you still don’t get to use it until all of that stuff is done.

Representative, Chelsea SPI, LLC [0:26:02] It’s all done. I’m just waiting for it to get signed off.

Chair Marnie MacAlpine [0:26:04] But that signed off is the approval is done.

Assistant City Solicitor Mark Rossi [0:26:07] The approval is contingent on all of the work being done and signed off. And so until that happens, the approval is not valid. The approval becomes effective.

Chair Marnie MacAlpine [0:26:26] And that’s where, honestly, you want to. If everything is done, you want your electrician hounding them.

Chair Marnie MacAlpine [0:26:32] To get that for you so you can get those next steps done. And hopefully there’s somebody available. They’ll be able to do it quickly. But it’s our job to make sure that all of the Other, like ducks are in a row. And it does involve all of those, like, stamps of approval, if you will, all across the world.

Representative, Chelsea SPI, LLC [0:26:52] It’s a pretty tough process. I had to bug so many people. But we’re here.

Chair Marnie MacAlpine [0:26:56] But you got to know everybody at city hall.

Representative, Chelsea SPI, LLC [0:26:58] I wouldn’t be here this many times if I didn’t have to.

Chair Marnie MacAlpine [0:27:01] You got to know the city really well, really quickly.

Commissioner [0:27:04] I think it’s clear what we need to do, but that was my question, so thank you.

Commissioner [0:29:48] But then as president. For everything. For every petroleum license. No, not for just this one Individual. Okay.

Assistant City Solicitor Mark Rossi [0:30:06] If the commission decides dealing with this license that’s presently before it to take the CPD’s recommendation that the active. With the cameras on site be active, it can become an condition of granting the license.

Chair Marnie MacAlpine [0:30:20] And the only licenses that are all required to have cameras are liquor licenses and cannabis licenses. Those are the ones that 100% have to. It’s not a question.

Unidentified speaker [0:30:35] Yes, I will say, since they’re selling gas there. Right. These people coming in now, I think it’s for their own benefit who have cameras.

Police captain [0:30:59] Yes, I do. It’s a. It’s a very busy roadway, you know, having the gas station there and, you know, I’m not sure you open at all hours. I don’t even know what your hours

Representative, Chelsea SPI, LLC [0:31:10] are, to be honest. Not all hours open. 6 to 9, 30 or. No, 6 to 10. Sorry, 6 to 10.

Police captain [0:31:19] But yeah, if he has no. I have to say, if he has no issue with the cameras, then, you know, I would recommend that everybody has cameras.

Chair Marnie MacAlpine [0:31:26] But do you have exterior cameras or just the interior? The.

Representative, Chelsea SPI, LLC [0:31:30] Mostly the exterior. I do know the hit and run. Just talking about this lady spoke to me.

Representative, Chelsea SPI, LLC [0:31:42] Honestly, I don’t mean to get my two cents, but I do recommend that all gas stations should have cameras. I work in the gas station business. We have like 20 something other locations. And every day there’s something. You know.

Chair Marnie MacAlpine [0:31:53] No, it’s beneficial for everybody to have that record.

Assistant City Solicitor Mark Rossi [0:32:15] And you will work with the CPD to the extent that there are any other cameras that the CPD recommends. Wonderful. Then you have an agreement by the licensee.
